Terms of Service
The conditions governing access to and use of Tripticonsent by customer organizations.
Effective date: September 13, 2026. By creating an account, clicking "I agree" during sign-up, or using the Service, you accept these Terms on behalf of the organization you represent.
Who we are, and who this is for
Tripticonsent is a product of Tripticode, S.L., registered at C/ Júcar 36B, 41012, Sevilla, Spain, tax ID B05654819 ("Tripticode", "we", "us"). The Service is offered exclusively to businesses and professionals acting in the course of their business — not to consumers. By signing up, you represent that you have the authority to bind your organization ("the Customer", "you") to these Terms.
Definitions
- Service: Tripticonsent’s API, console, SDK, cookie scanner, and AI-agent connector (MCP), together.
- End user: a person whose consent or preferences the Customer manages through the Service.
- Customer Data: any data, text, configuration, or record that the Customer or its end users enter into the Service, including consent vault records.
- API keys: the credentials (
pk_/sk_, intestorlivemode) that identify the Customer to the Service.
The Service
Tripticonsent is a consent and preference management platform: it captures, versions, append-only stores, and lets you prove and revoke consent decisions, backed by cryptographically signed receipts. The exact functional scope of your plan may vary; the API reference (/reference) and the documentation (/docs) describe the Service’s current behavior.
Accounts and registration
- You must provide accurate information when signing up and keep it current.
- You are responsible for keeping console access credentials confidential (including a session started via "Continue with Google" or an emailed magic link) and for all activity under your account.
- You must notify us without undue delay of any unauthorized use of your account you become aware of, by writing to support@tripticode.com.
- Each customer organization must designate at least one administrator with authority to manage the rest of the team.
Plans, pricing, and billing
Applicable fees are those in effect at the time of purchase or renewal, per the plan published at tripticonsent.tripticode.com/pricing, the one selected in the console, or the one agreed in writing for the Scale plan. Unless stated otherwise, billing is monthly, with overage past the included quota aggregated and billed once per cycle — never as standalone charges per event block — and stated amounts exclude taxes, which are the Customer’s responsibility where applicable. Payment is processed through Stripe, a sub-processor described in the privacy policy; we never store your payment method details. Non-payment following notice may result in suspension of access under the "Suspension" section below.
Customer Data and data protection
When you use the Service to capture or manage consent or preferences from your own end users, you are the data controller for that data and Tripticode acts as a data processor, as described in our privacy policy. You are responsible for having a sufficient legal basis for the processing you carry out, and for your own legal notices to your end users being adequate. Our Data Processing Agreement (Art. 28 GDPR) is part of these Terms for every plan and applies automatically; it prevails over this section in case of conflict. A negotiated DPA is available on the Scale plan.
Acceptable use
When using the Service, you agree not to:
- Use it for unlawful purposes, or to capture consent you know to be false, misleading, or not the end user’s actual choice.
- Attempt to circumvent, disable, or interfere with the Service’s security mechanisms, rate limits, or the isolation between
testandlivemode. - Reverse-engineer the Service, except to the extent applicable law mandatorily permits it.
- Resell, sublicense, or make the Service available to third parties as if it were your own, unless your plan expressly provides for it.
- Upload malware to the Service, or content that infringes third-party intellectual property or data protection rights.
- Subject the Service to uncoordinated load or security testing that could affect other customers; contact us before doing so.
API keys and security
API keys are secret. You are responsible for restricting their access, rotating them if you suspect compromise, and using test mode for development — never real end-user data in test mode. Tripticode may revoke a key without prior notice if it detects usage that puts the Service’s security or other customers at risk.
Service availability
We work to keep the Service continuously available, but we do not guarantee a specific service level (SLA) unless separately agreed in writing. We may perform scheduled or emergency maintenance; where reasonably possible, we will give advance notice of scheduled maintenance.
Intellectual property
- Tripticode and its licensors retain all rights in the software, brand, documentation, and any underlying technology of the Service. These Terms grant you no ownership, only a limited, non-exclusive, non-transferable, revocable license to use the Service under your plan.
- You retain all rights in your Customer Data. You grant us the license strictly necessary to host, process, and display that data solely to provide you the Service.
- If you send us suggestions or feedback about the Service, you may do so, and we may use them freely to improve the Service, with no obligation of compensation or attribution.
Confidentiality
Each party agrees to protect the other’s confidential information with at least the same degree of care it applies to its own confidential information (and in no case less than reasonable care), and not to disclose it to third parties except where required by law, in which case it will notify the other party when legally permitted. Information that was already public, that the receiving party already lawfully knew, or that is independently developed is not considered confidential.
Warranties and disclaimer
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, Tripticode disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted, nor that using it alone is sufficient to satisfy all of your legal data-protection obligations — that also depends on how you configure and use it.
Limitation of liability
To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, punitive, or consequential damages, or for loss of data, revenue, or goodwill, arising from use of or inability to use the Service. Tripticode’s total aggregate liability to the Customer under these Terms will not exceed the amount the Customer paid for the Service in the twelve (12) months preceding the event giving rise to the claim. These limitations do not apply to damages caused by willful misconduct or gross negligence, or where applicable law does not permit limiting liability.
Indemnification
The Customer will indemnify Tripticode against third-party claims arising from: (a) Customer Data, (b) the Customer’s or its end users’ breach of these Terms, or (c) the Customer’s use of the Service in infringement of third-party rights.
Term, suspension, and termination
- These Terms remain in effect for as long as you maintain an active account or a contracted plan.
- You may cancel your account at any time from the console or by writing to support@tripticode.com; cancellation takes effect at the end of the current billing cycle unless otherwise agreed.
- We may suspend or restrict access to the Service, with notice where reasonably possible, in the event of non-payment, well-founded suspicion of fraud or abuse, a risk to the security of the Service or other customers, or where a legal order requires it.
- We may terminate these Terms for material breach not cured within a reasonable period after notice.
- Following termination, we will make available a reasonable period (at least 30 days, unless the law requires otherwise) for you to export your Customer Data before it is deleted, per the retention policy described in the privacy policy.
Changes to the Service and these Terms
We may update these Terms or the Service over time. Where a change is material, we will reflect it on this page with a new effective date and, where reasonably possible, notify you in advance by email. Continued use of the Service after a change takes effect constitutes acceptance of it.
Sub-processors and third-party integrations
The Service relies on several infrastructure providers to operate — full detail, including role and location, is in the privacy policy’s sub-processors section.
Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute that cannot be resolved amicably will be submitted to the courts of Seville, Spain, with the parties expressly waiving any other forum that might otherwise apply to them.
General provisions
- These Terms, together with the privacy policy, the Data Processing Agreement and, where applicable, a negotiated DPA, constitute the entire agreement between the parties regarding the Service.
- If any provision is found invalid or unenforceable, the rest of these Terms remains in effect.
- You may not assign these Terms without our prior written consent, except as part of a merger, acquisition, or substantial sale of assets.
- Neither party is liable for failures caused by circumstances reasonably beyond its control (force majeure).
